What is the Fee for filing a copyright application in India?

Should we file a Copyright application in each country?

No! Copyrights is a universal right. Copyright is a right possessed by the creator from the time of creation, so it is not mandatory to file for a copyright application. However, when you must prove that you are the owner of the content especially in case of litigation, it is evident that you have a certified copy from the Copyright office.

WHAT IS COPYRIGHT?

A copyright is a form of Intellectual property rights given to the form of expressing an idea. Any form of expression of an idea is copyrighted, however the idea itself is not protected under the copyrights.

WHAT CREATIVE EXPRESSIONS ARE PROTECTED UNDER COPYRIGHTS?
The register of the Registrar of Copyrights is divided into 6 categories:

  • PART – 3: Artistic Works
  • PART – 4: Cinematography Films
  • PART – 5: Sound Recording
  • PART – 6: Computer Programs, tables & Compilations

Stages of Copyright Protection

  • Dairy Number Issued – Mandatory waiting for 30 days for any objection from public.
  • Examination - Acceptance
  • Objection – Hearing
  • Issuance or Appeal

To file for a copyright application, we need to fill form IV with all necessary details. Filing can be done via the online mode, and once submitted, the copyright office allocates a Diary Number (Reference Number). Post this, there is a waiting period for the 30 days in case of objection. If there is no objection the Copyright office will examine the application and if satisfied with the legal requirements register and grant the application.

The basic documents required for the copyright registration are Name, Address & Nationality of the Applicant and creator of the original work. The ID proof of the owner and Incorporation certificate in case of business is also required. Soft copies of the work to be copyrighted should be provided online and hard copies to be sent to the copyright office.

Copyright registration is nor mandatory, however, it is essential in proving the ownership of a creative content. Any person or business entity can apply for copyright registration. The individual can be author, creator, musician, photographer, producer, painter, composer, or a company can safeguard their unique creativity by registering under the copyrights Act

Yes! One can place the copyright symbol on any original piece of work he/she has created. It is a universal right and does not need to be mandatorily filed. However, it is necessary to file for a copyright making it easy to enforce it.

The copyright holder has following rights:
  • The right to copy or reproduce the original work.
  • The right to determine who may modify the work to other forms and determine benefits from the same.
  • The right to be attributed to work.
  • The right to sell and get royalty of the work.
No! if the Copyright office reject the application, no fees paid to the Copyright office nor the fee paid to Patwise is reimbursed. Hence it is suggested you do a Copyright evaluation and search prior to investing money in any of the IPR procedure.
